It has nothing to do with WHOIS. It's a failure to verify registrant data.
WHOIS is only a "view" into the Registrar/Registry database.

This case is about illegal registrations, not about "access to data".

Even if there would be no WHOIS service at all, the registration itself
would be fraudulent.
