Below are the draft preliminary descriptions.

Session 1:  WHOIS/RDS Policy – Post-GDPR Developments and Next Steps (Tuesday June 26, 2018; 15:15 – 16:45 local time)


Description: The European General Data Protection Regulation (GDPR) has precipitated significant changes to the registration data directory service, currently known as WHOIS. Most recently, the ICANN Board adopted a Temporary Specification implementing an ICANN Org-driven interim GDPR compliance model for WHOIS.  However, the Temporary Specification may only be in effect for up to one year, and triggered an expedited policy development process to create a new ICANN Consensus Policy concerning gTLD registration data directory service.  However, efforts to reach community consensus regarding updating the WHOIS system has historically been rife with challenges.  With the adoption of the Temporary Specification, the community has a new opportunity, with specific milestones, to try and devise an “ultimate model” for a next-generation registration data directory service that meets the needs of various stakeholders with a legitimate interest in domain name registration data, while also respecting applicable privacy and data protection laws.  In this cross-community session, panelists will engage with the community to discuss the key policy changes resulting from the Temporary Specification, and how to move forward with developing a final Consensus Policy that moves beyond the temporary policy toward a more permanent solution for the RDDS.

Session 2: Accreditation and Access to Non-Public WHOIS Data Post-GDPR (Tuesday June 26, 2018; 17:00 – 18:30 local time)



Description: Under the Temporary Specification passed by the ICANN Board implementing the interim GDPR compliance model, there is a placeholder for an accreditation system to facilitate uniform access to non-public WHOIS data by appropriate users for legitimate purposes.  Under the current iteration of the Temporary Specification, contracted parties must provide access to non-public registration data for the legitimate purposes specified in Section 4 of the Temporary Specification, unless the request for access is outweighed by the domain name registrant’s fundamental right to privacy.  However, there is no uniform system for approving legitimate users to obtain access to non-public registration data in connection with such legitimate purposes, and streamlining the process so it is less burdensome for contracted parties who otherwise must perform ad hoc individual review of each request for data.  Certain members of the community have been working on such a system for credentialed access to non-public data, and it is urgent that ICANN and the community come together to push forward a workable credentialed access system for non-public WHOIS data for legitimate purposes with a fundamental role in preserving the security and stability of the Internet’s unique identifier systems.  In this cross-community session, panelists will engage with the community to discuss work to date on developing a credentialed access system for non-public registration data, and seek to generate ideas for next steps for integrating such a system into a future iteration of the Temporary Specification or as part of the expedited policy development process to devise a Consensus Policy for RDDS.
