Indeed, you make well the case that the status quo does not provide
sufficient penalty (or for that matter, any liability beyond loss of the
domain name).

If you're going to stack up the exposure on searchers, there ought to be at
least as much liability on registrants that fake the search responses.

OTOH, if you want to leave the existing lax penalties on registrants, fine,
but then lay off the exposure demanded from searchers.
