Based on a number of non-related examples, I've seen this problem licked
elsewhere, through the requirement for user-specific API keys. The issuance
and use of said keys is dependent on the recipients' agreeing to the
appropriate ToS.

While I'm arguing that WHOIS data should be accurate and available, I do
not see registration and ToS acceptance as being an unreasonable barrier to
access.
