Yes - they're right

You may not like it, but that's what whois was originally designed to do

Yes and I'd agree.

As a registrar we get a lot of our clients complaining about their details being made available in public whois

I think you're confusing things

Have a read over what ICANN / LEA is asking
Have a look at PCI / DSS 
Have a proper read over the Article 29 letter
