The problem with this report was in the terms of refernce: They were not 
asked to actually measure ICANN's actions against the specific requirement 
of ICANN's Bylaws.

This was one of several comments in which I pointed out the violations of 
the Bylaws in each of the 3 "accountability" mechanisms: failure to 
propoerly appoint an Ombudsman, a decision by the reconsideraiton 
Committee explicitly based on information (communications with the 
Ombudsman) not in the public record, and failure to propoerly designate an 
independent review provider or procedures for independent review.
