[NA-Discuss] Backorder before Redemption Period

Hi!

We had a domain registered with registrar "X" and that domain should
be now in Redemption Period. But if I do a whois query to that domain it
shows that now is renewed and registered with registrar "Y" (property
of registrar "X").

In registrar "X" say: Whenever a domain name expires it goes in the Add Renew Grace period. Since there was a backorder for the domain name it did not go in the Redemption Grace Period. The domain was registered under your a/c , however failing to renew the domain name domain expired and there after 40days of grace period the domain was backorder by a customer. Please note that the domain name was not transferred.

Is the first time that I hear something like that.
A backorder can be done before the domain goes to Redemption Grace
Period and deleted later?

Is that legal?
