Hi Eric,

Just to correct a couple of things that you have stated below.

To clarify, Section 17 of our Rules of Procedure states, "The members of the unaffiliated individuals, including the representative to the NARALO General Assembly must submit a Statement of Interest indicating that they meet the following criteria...".  Further, Section 5 states, "The Chair shall be empowered to issue Calls
for Statements of Interest for service on the ALAC and to sign and receive any official correspondence to and from ICANN or the At-Large Structures."

Normally members of NARALO will submit their SOIs on the NA-DISCUSS list in order to keep the RALO well informed and to have transparent mechanisms.  However, it would also be acceptable for SOIs to be submitted to the Secretariat (who would pass it on to the Chair) or to the Chair directly, as specified above.  I can see absolutely no proof of any of this happening.

Also, since our region and its ALSs seem to have come under the magnifying glass, as Secretary I have to ensure that the election process goes through without any kind of perceived inaccuracies.  So, I had to disqualify your nomination for Glenn for two reasons:

1.  It could easily be brought up in the future that I had not performed due diligence on the nomination/election process; and
2.  More importantly, it could have brought up questions in the future as to whether Glenn had been properly nominated and called into question our entire elections process.  Should Glenn be elected, this could definitely have come back to haunt him.  I was very glad that Eduardo stepped forward to nominate him because if he hadn't, I would have.

Having to know the Rules of Procedure inside and out is a bit of a pain sometimes but it also helps in foreseeing problems that could crop up in the future.  A brutal and thankless job but a necessary one.  It also seems to be a job where one is constantly being set up as some kind of target (the "procedure police").  I'm afraid I am a bit like a momma bear protecting her cubs in this regard.  When I see anyone in this region possibly setting themselves up for negative consequences, I do everything that I can to ensure that things are done right to forestall this harm.

Further, you stated, "A continuous scheme consisting only of the formality of testing for the existence of a "vote"...".  Voting is not the only means we have of testing the participation of an ALS by any means.  Section 16 of our Rules of Procedure state, "When an ALS representative does not vote in 3 consecutive NARALO elections or does not contribute a comment on ICANN policy through collaboration on the At-Large discussion lists in 12 consecutive months, it automatically loses its voting rights and active status within the NARALO."  So, it isn't just voting that automatically grants an active status.  It is also collaboration in the discussion lists.  This could not be achieved through a votebot.  In my mind, collaboration is much more important that voting but there has to be some mechanisms in place to measure at least quantitative participation, if not qualitative.

My contributions to agenda item 5.1.3 (also labeled "3.1.3") "Review of Active and Non-Active ALSes" are the mail sent on 6/13. I regret a spreadsheet capturing all of the salient details is incomplete but will be forthcoming.

My contributions to agenda item 5.1.4 (also labels "3.1.4") "Overview of ALS De-accreditation Procedures" is that the criteria used can be met by a votebot (CORE in fact uses a votebot scheme, as do other organizations using email-based balloting systems), or by a single individual, and therefore renders fictional the plain sense of the
2007 MoU creating NARALO out of regional organizations meeting specific criteria and undertaking specific responsibilities and so becoming At-Large Structures comprised of one or more organizations, and Unaffiliated Individual members.

A continuous scheme consisting only of the formality of testing for the existence of a "vote" from something other than an organization has the effect of making one individual styled as an At-Large Structure equal in voting to all Unaffiliated Individual members, and equal to all At-Large Structures.

As individuals, as members of At-Large Structures or Unaffiliated Individual members have property interests affected by the decisions of the Board, and votes in NARALO give rise to acts which advise the Board, equity and due process issues are present in a correctable, but continuously uncorrected voting scheme.

My contributions to agenda item 5.1.5 (also labels "3.1.5") "Disconnect Between "Individual Internet Users" and the reality of ALSe" is to observe that more than one currently certified At-Large Structure" appear to have fewer members than there are Unaffiliated Individual members, though the number of Unaffiliated Individual members I believe on the available information may be as few as six, not including myself as the Secretariat has again, for reasons not yet made clear, that I am not an Unaffiliated Individual member.

My suggestion is that the "one vote in four" criteria for continuous certification as an ALS be replaced with a test that is organic to the
2007 MoU responsibilities of the NARALO and organic to the subsequent application and capable of discovery of material misrepresentation.
This is not particularly difficult and a responsibility of Officers selected by vote. Such a test could detect persistent failures to inform and enable individual participation, the central purpose of a committee tasked to advise from the perspective of individual internet users, which the current scheme can not.
