posición, queremos explicar
la naturaleza de lo que es punto de orden.<o:p></o:p></span></p>

<p class="MsoNormal"><span
style="font-family:"Arial",sans-serif;
mso-ansi-language:ES-CL" lang="ES-CL">Reglamento de
Procedimientos de la UNGA, en especial,
el art 79 del ANEXO IV (a) del Reglamento de la Asamblea
General, da un
concepto de lo que es un punto de orden:<o:p></o:p></span></p>

ES-CL" lang="ES-CL">79. El Comité Especial recomienda a la
Asamblea General que apruebe el
siguiente texto como descripción del concepto de las cuestiones
de orden [párr.
229]:<o:p></o:p></span></p>

ES-CL" lang="ES-CL"><o:p> </o:p></span></p>
<p class="MsoQuote" style="text-align:justify"><span
style="mso-ansi-language:
ES-CL" lang="ES-CL"><span style="mso-spacerun:yes"> </span>"<b
style="mso-bidi-font-weight:
normal"><u>Fundamentalmente una cuestión de orden es una
intervención dirigida
al Presidente para solicitarle que haga uso de determinada
atribución inherente
a su cargo o que le confiere concretamente el reglamento</u></b>.
Puede, por
ejemplo, referirse a la manera de dirigir el debate, al
mantenimiento del
orden, a la observancia del reglamento o a la manera en que los
Presidentes
ejercen las atribuciones que les confiere el reglamento. En
virtud de una
cuestión de orden, un representante puede solicitar del
Presidente que aplique
determinado artículo del reglamento o impugnar la forma como el
Presidente
aplica dicho artículo. Por lo tanto, los representantes pueden,
dentro del
ámbito del reglamento, señalar a la atención del Presidente las
infracciones o
las aplicaciones incorrectas del reglamento por otros
representantes o por el
propio Presidente. Una cuestión de orden tiene precedencia sobre
todo otro
asunto, incluso las mociones de procedimiento (artículos 73
[114] [artículo 71
[113] del presente reglamento.] y 79 [120] [artículo 77 [119]
del presente
reglamento.]). <o:p></o:p></span></p>

style="mso-ansi-language:
ES-CL" lang="ES-CL"><o:p> </o:p></span></p>
<p class="MsoQuote" style="text-align:justify"><span
style="mso-ansi-language:
ES-CL" lang="ES-CL"><span style="mso-spacerun:yes"> </span>"Las
cuestiones de orden
planteadas en virtud del artículo 73 [114] entrañan asuntos que
exigen una
decisión del Presidente, con sujeción a una posible apelación. <b
style="mso-bidi-font-weight:normal"><u>Se diferencian, por lo
tanto, de las
mociones de procedimiento de que tratan los artículos</u></b>
76 [117]
[artículo 74 [116] del presente reglamento.] a 79 [120][Artículo
77 [119] del
presente reglamento.], que sólo pueden decidirse por votación y
respecto de las
cuales puede tratarse al mismo tiempo más de una moción, cuyo
orden de
precedencia se establece en el artículo 79 [120][Artículo 77
[119] del presente
reglamento.]. <b style="mso-bidi-font-weight:normal"><u>Se
diferencian también
de los pedidos de información o aclaración y de las
observaciones que se
refieren a disposiciones materiales (asientos, sistema de
interpretación,
temperatura de la sala), documentos, traducciones, etc.,
que, si bien pueden
necesitar que los atienda el Presidente, no exigen una
decisión formal de su
parte. No obstante, conforme a la práctica establecida en
las Naciones Unidas,
un representante que tiene intención de presentar una moción
de procedimiento o
de solicitar información o aclaración, con frecuencia
plantea una
"cuestión de orden" a fin de obtener el uso de la palabra.
Este uso,
que se basa en razones prácticas, no debería confundirse con
el planteamiento
de cuestiones de orden en virtud del artículo 73 [114].<o:p></o:p></u></b></span></p>
<p class="MsoNormal"><span
style="font-family:"Arial",sans-serif;
mso-ansi-language:ES-CL" lang="ES-CL"><o:p> </o:p></span></p>
<p class="MsoNormal" style="text-align:justify"><span
style="font-family:"Arial",sans-serif;mso-ansi-language:ES-CL"
lang="ES-CL"><span style="mso-tab-count:1"> </span>Si
se revisa su petición, en ella no
se dirige al Presidente “<i style="mso-bidi-font-style:normal">para
solicitarle
que haga uso de determinada atribución inherente a su cargo o
que le confiere
concretamente el reglamento</i>”, si no que solicita <span
style="mso-spacerun:yes"> </span>“<i
style="mso-bidi-font-style:normal">Que la
asamblea general demuestre su falta<span
style="mso-spacerun:yes"> </span>de
confianza en los líderes de LACRALO y vote sobre esta<span
style="mso-spacerun:yes"> </span>moción.</i>”<o:p></o:p></span></p>
<p class="MsoNormal" style="text-align:justify"><span
style="font-family:"Arial",sans-serif;mso-ansi-language:ES-CL"
lang="ES-CL"><span style="mso-tab-count:1"> </span>En
términos simples, lo que Ud.
expresa que es un punto de orden, en realidad no es. Por ello,
no es posible
darle dicho tratamiento.<i style="mso-bidi-font-style:normal"><o:p></o:p></i></span></p>

4. Subsequently, the 7th of September 2015 Alberto Soto informed that he
had asked for legal advice from ICANN’s legal staff regarding this motion
of censure.
5. The RoP in Articles 8.1 and 8.2 states the following:
8.1 During a discussion, any delegate may raise a point of order; such a
point of order shall be immediately decided upon by the presiding officer.
8.2 An appeal may be made against the ruling of the presiding officer.
Such an appeal shall be put to the vote immediately and the presiding
officer's ruling shall stand, unless overruled by a simple majority of
the ALS present and voting.
These rules are silent regarding any suspension. Neither there has been
any appeal. In any case, an appeal did not suspend the current vote.
6. There are articles relating to the suspension in Rule 9 that provides:
Rule 9 - Procedural Motions
9.1 During a discussion, any delegate may move the suspension or
adjournment of the meeting or the adjournment or closure of the debate.
9.2 Such a motion shall be put to the vote immediately. Subject to Rule
8.1, such motions shall have precedence in the following order over all
other proposals or motions before the meeting:
(a) Suspension of the meeting;
(b) Adjournment of the meeting;
(c) Adjournment of the debate on the question under discussion;
(d) Closure of the debate on the question under discussion.
7. - Finally, with regard to the arguments and accusations of Mr. Samuels,
they will be answered once the official translation into Spanish is sent to
the LACRALO's Spanish list.

of No Confidence. According to the RoP, this motion needs to be debated and
voted BEFORE the vote on ALAC rep can continue (it takes precedence). This
hasn't been done, so how can the vote on ALAC rep be ending tomorrow?
Or was there a vote on the motion and I missed it?
I am particularly concerned given the number of procedural mistakes that
