Muchas Gracias Humberto. Una sentencia con una fundamentación muy
interesante respecto a la ponderación entre los distintos derechos como
bienes jurídicos valiosos a la sociedad, entre la seguridad y la protección
de datos personales en el caso concreto planteado ante la justicia, en que
juega de manera importante el principio de la proporcionalidad . Es un
mundo complejo que exige profundidad en el análisis y articulación de las
normas jurídicas. También entiendo es importante tener en cuenta los
distintos contextos, se nota el importante desarrollo que en la materia
tiene la UE, que responde a una realidad diferente a la de las profundas
asimetrías que se plantean en latinoamérica. Por mi país tenemos todavía
muy poca jurisprudencia al respecto.
