Alejandro, the intention is not to form a library. Often training please. This is a form of training: searching and reading, and who performs as desired, without impositions. No libraries contain this information, and those that exist in each country with its own laws, do not require any use agreement. The songs, and happily stayed in the past, but is part of all we have to do.

For what? A few examples of the many for which we need to know a bit more Personal Data Protection:

- ICANN's public consultation on 2013 RAA Data Retention Specification Data Elements and Legitimate Purposes for Collection and Retention1

- New gTLD Program. Personal Data Privacy statement: 1.International transfer ...

- Article 29 Data Protection Working Party (Brussels, JUN 2013)

- Letter to ICANN Top European Data Protection Board (April 2014). Re: Data collection, retention and l aprivacidad in the context of the contract of Registrars (RAA 2013)

- WHOIS Beta. Task Art. 29

- Montevideo Declaration on the future of the internet that cooperation was one of the basic elements of the Strategic Plan 2013-2015 of the Latin America and Caribbean Region.

During the comment period, we believe only two people on the first example. Javier Pallero now have an excellent professional whose knowledge on this subject is really outstanding.

Also lack training in other subjects such as WHOIS, and other more technical and Security DNSs and several of the same or greater complexity.

But we can not do it all together, but together we can do it.

Just ask all work together, and one of the forms is giving me time to continue working on it.

Best Regards

Alberto,

but ... what would be the discussion? What would be the object that LACRALO do the work of forming a library of laws protecting personal data?

We will reverse:

Libraries and there, made by professional organizations devoted to the subject of so much privacy as the file and library. To access the laws is best to seek one of these collections and make arrangements for possible use.

But above all for what? Are we going to do a project LACRALO - as it should be, with mission, vision, objectives, goals, resources allocated, engagements, charter, iron triangle, accountability ... - comprises confront each region ccTLD with applicable laws in your country?

Sounds a little ambitious to do a collection of songs and would have to be very well prepared to undertake it. And sure that there is no better instance - for example, in each country, or the type of Interamerican Observatory Privacy - now you are doing.

There is another problem in this field will face as users in some countries in the region: international treaties such as the TPP or TPPA (Trans-Pacific Partnership Agreement) include very specific clauses that determine the characteristics of the "whois" in ccTLDs, always in favor commercial interests, particularly those of companies in EU. Are we prepared as LACRALO to address this issue? (I can present more details if required).

In associations that represent you, are you in touch with ccTLDs on some of these issues? What positions have our associations?

Best regards.

Thanks Javier! I think I would ask you please every member of our ALS, to try to send the legislation of your country in this regard. If there is a Law of Protection of Personal Data (the link ...), if it is being fulfilled, if there are other ways to obtain personal data. In several countries there are organizations that provide quasi ghost data against current legislation. It is the foundation we need for a good discussion.

Best Regards

This is interesting because in Argentina Alberto, for example, you can access the name, Tax ID number, ID and data delegation of any registrant https://nic.ar/busqueda-dominio-no-disponible.xhtml

In the old system could meet the physical address that was also recorded. But also with the data found in the search that is not hard to figure out.

There are certain details (name, national identity, social security or tax identification, occupation, date of birth and address) that the law allows treating Argentina without obtaining the consent of the owner, making them "free circulation". They are showing nic.ar <http://nic.ar><http://nic.ar> And sometimes, these data are too (especially when today analyzing extracts metadata information beyond what is explicit)

Our law (and to my knowledge, several in the region) followed by the European Directive 95/46/EC and still current reform process. But at least in the case of Argentina missing something that the European directive itself has: express references to principles of proportionality. Not just about what data may be trafficked freely, but how much is necessary to fulfill the purposes of registration.

In what concerns us, it is the proportionality in the data shown and its utility for the public register of holders of country domains point. It would be interesting efecturar a good survey and establish some principles to assess how managers treat ccTLDs in the region (and how they should be treated) data ownership.

Finally, in the uk the European Directive does not apply, and almost like USA, laissez faire holds the reins. Also serves to these questions that come to mind for the region.

Greetings.
