[LAC-Discuss] "Conflict of Interest"? Y forgot a thing.

Estimados Amigos,

Luego de leer los últimos mensajes de la lista, y de haber conversado acerca
de este tema con algunos miembros de la comisión directiva de ISOC.Ar, nos
hemos sentido obligados a enviar nuestros comentarios:

La hipótesis de conflicto de interés que señala Andrés encierra varios
problemas y contradicciones. En primer lugar, Erick Iriarte participa en la
LACRALO representando a Alfa Redi, no a LacTLD. Aunque así fuera, debe
destacarse que la primera regla de administración de los ccTLD (contenida
tanto en los rfc pertinentes como en los memorandos de IANA) es que dichos
registros se operan en beneficio de las comunidades locales. Por lo tanto, y
teniendo en cuenta la pluralidad de intereses representados por el at-large,
no veo que exista ningún conflicto de interés. Por otro lado, recuerdo
vívidamente las discusiones mantenidas a partir de la incorporación de
Siavash Shahahani al ALAC. Siavash era (y aún es) el administrador del ccTLD
iraní. Luego de soportar acusaciones del tenor de la que aquí se discute,
Siavash fue (en mi opinión) uno de los mejores ALAC reps que el comité ha
tenido, representando cabalmente a los usuarios de su región, en temas bien
complejos que requirieron altos niveles de conocimientos, como la discusión
de los IDNs.

Lo que intento mostrar, es que un excesivo rigor en la apreciación de
supuesto conflictos de interés puede llevarnos no solo a profundizar métodos
anti-participativos en la LACRALO, creando un precedente peligrosos e
innecesario, sino también a privarnos de tener un muy buen representante.

Ello en cuanto a las opiniones de ISOC.Ar

En cuanto a mi opinión personal, si es que me permiten expresarla, lamento
profundamente que aquellos miembros de la LACRALO que conocieron ICANN y se
involucraron en la organización a partir del trabajo de quienes integrábamos
el Interim ALAC hace ya algunos años, hayan elegido un camino de
enfrentamiento y desvalorización de aquellos que invirtieron tiempo y
esfuerzo en crear un mecanismo de participación amplio y abierto.

Dear Friends,

After reading the last messages on the list, and discuss them with some
ISOC.Ar board members, we felt compelled to send you our comments.
Andrés´ hypothesis of a conflict of interests have some problems and
contradictions. In the first place, Erick Iriarte participate here
representing Alfa Redi. Even when he were representing LacTLD, it must be
noticed that the first rule in ccTLD administration is the benefit of the
local communities. Given so, and talking in account the plurality of
interests represented by the at-large, we don´t see any conflict of
interest. 
Form another point of view, I remember the discussions we have when Siavash
Shahahani was appointed to the ALAC. Sivash was (and still is) the
administrator of the Iranian ccTLD. After dealing with accusations like this
one, Siavash finally stayed and he was one of the best ALAC reps that the
ALAC have ever had, representing user in complex matters, like IDNs.
What I´m trying to show here, is that excesses in the appreciation of
conflict of interests may not also set dangerous precedents, intensifying
LACRALO existent anti-participation methods, but also prevent our
organization from having a fine representative.
This is what ISOC.Ar feels about the matter.

Regarding my personal opinion, if I may express it, I deeply regret that
some members of the LACRALO, involved in the ICANN process thanks to the
efforts of those who worked in the interim ALAC years ago, choose a way of
confrontation and discredit of those who have invested time and effort in
creating an open and wide participation mechanism.
