Carlos,
Can you please point me to the exact sentence in the Bylaws or other
institutional ALAC documents that states that NomCom ALAC members are
different from RALOs ALAC members?
If there is no such sentence, I assume that, as a lawyer, you would agree
that they have to be treated as equal.
I am not native English speaker, and I ask the assistance of native English
speakers to suggest what is the word that defines "giving lesser rights to
people that are legally equal", if "discrimination" is not the right one.
And I insist that if ALAC does that it will behave differently than the GNSO
and the Board itself.
On the other hand, if ALAC really feels that Chair and Vice-Chair should
come from RALOs and not NomCom, this would be a very legitimate position
(for the reasons explained by Wendy), but I am afraid it would require a
change in the ALAC institutional documents. Absent that, we cannot
discriminate, or differentiate, or whatever an appropriate word would be,
one third of the ALAC members. It would just not be compliant with the rules
of the game.

My position in this matter is quite similar than Wendy and Beau. I consider
that "discrimination" is not the proper word to use in this case.
