[ALAC] .aero provides no port 43 whois

According to the .aero sponsorship agreement, .aero must provide port 43
whois service.

An attempted port 43 whois query fails, however:

 $ whois airinfo.aero
 This TLD has no whois server, but you can access the whois database at
 http://www.nic.aero/

Is .aero violating its registry agreement?  If so, would the public have
any recourse?
