<b>Proposed Session Title * Beyond Budapest: the UN cybercrime
treaty and DNS Abuse </b><b><br>
</b>
<p>Brief Description (max 250 words) * This session looks into the
progress and perspectives of the proposed UN cybercrime treaty and
explores how it might impact ICANN’s mission. Its point of
departure will be the recent reports from ICANN’s UN engagement
team <a class="moz-txt-link-rfc2396E" href="https://www.icann.org/en/system/files/files/un-update-cyber-related-discussions-15jul20-en.pdf"><
https://www.icann.org/en/system/files/files/un-update-cyber-related-discussions-15jul20-en.pdf
></a>. It seeks to explore whether the ongoing UN discussions
impact ICANN’s understanding of DNS abuse such as CASM, online
fraud or any other online activity the community considers
harmful. We would also like to take this opportunity to look at
the international cybercrime treaty already in place: the CoE
Budapest convention and what mechanisms it offers to effectively
protect internet users from DNS related abuse. We would like to
invite speakers from the UN engagement team to give the background
for our discussions, welcome representatives from the Council of
Europe (GAC observer) as well as from the contracted parties
community to discuss the DNS Abuse framework. <br>
Rationale/Desired Outcomes * We’re seeking to answer the following
questions: How does DNS Abuse fit in with existing cybercrime
frameworks, both: national and international? Can cybercrime laws
be useful for fighting DNS Abuse? What are the opportunities for
having the ICANN voice heard in international cybercrime
discussions? We will also seek to identify opportunities for
enhanced ICANN community input into this and similar processes
that directly impact the effectiveness of our DNS Abuse
mechanisms.<br>

<b>Proposed Session Title: EU’s Digital Services Act – a new GDPR
in the making?</b><b><br>
</b>Brief Description (max 250 words) * Following the recent
report from the IGO Engagement team on the EU Digital Services Act
we would like to explore the challenges and opportunities this EU
legislation holds for the ICNN Community. Learning from the GDPR
experience, we would like to understand and prepare for any
similar challenge in terms of contracted parties obligations and
ICANN policy development processes. With the DNS Abuse framework
still under discussion, we would like to identify any potential
legal duties that might fall onto community members in EU and
beyond should this legislation become binding. As explained in the
IGO report: “Within the DNS ecosystem, registrars could be
affected. ICANN’s Registrar Accreditation Agreement already
provides that registrars shall be able to receive and act upon
notification of providers of illegal content “by law enforcement,
consumer protection, quasi-governmental or other similar
authorities.” Under the DSA, digital services providers would be
required to extend such notification systems to the general
public, for reporting unwanted content.” <br>
Rationale/Desired Outcomes * This session seeks to spread
awareness of this EU originated activity and its potential impact.
We would like to welcome ICANN’s IGO team representative, European
Commission as well as members from the contracted parties
community, likely impacted by the legislation. <br>

discussions around key
business and economic
aspects of the
businesses and how these
may need to be
considered within the
broader ICANN Community
and policy making
functions. In addition
to the development of
the market, topics such
as the secondary market
for domain names,
approaches to abuse and
issues with resellers
will be covered by

given to the different

well-informed by fact is
clearly optimal. Such
policy making includes
having the best access
to all data including an
understanding of the
commercial drivers of
the protagonists. The
domain name services
sector has seen far
reaching changes take
place over a number of
years including the
development of a range a
diversity of business
models within both
Registry and Registrar
business. Extensive
competition has
developed in some areas
and substantial
consolidation and
corporate transactions
continue to take place.
The broader ICANN
community will benefit
from an understanding of
the key marketplace
drivers and dynamics
when considering all
future policy, including
high-profile current
issues such as future
rounds of new gTLDs.</span></p>
